Terms and conditions

This English version was translated by AI and is provided for convenience only. Only the Czech version is authoritative and legally binding.

Terms and conditions of the Johanes Sklo online shop, effective from 13th October 2026.

1. Introductory provisions

1.1. These terms and conditions govern the rights and obligations arising from the purchase of goods in the online shop at johanes-sklo.cz (the "shop").

1.2. The seller is David Johanes, Company ID (IČO) 64099431, with registered address at Polská 528/43, 779 00 Olomouc, entered in the Trade Register kept by the Olomouc City Council (Magistrát města Olomouce) (the "seller").

Contact: email johanes-sklo@seznam.cz, phone +420777284739. Address for returns and defect claims: Polská 528/43, 779 00 Olomouc.

1.3. The seller is not a VAT payer.

1.4. The buyer is a consumer or a business that submits an order in the shop (the "buyer"). A consumer is a person who enters into a contract with the seller outside the scope of their business or independent profession. Provisions that apply only to consumers are marked as such; Article 11 applies to a buyer who is a business.

1.5. The contract can be concluded in Czech. Only the Czech version of these terms is binding; the English version is a machine translation provided for information and is marked as such on its page.

1.6. The seller keeps the concluded contract (the order) in electronic form. The buyer can access it in the confirmation email, in the customer account (if one has been created) and from the seller on request.

2. Goods and their characteristics

2.1. All goods are handmade glass. We make the figures by hand only after the order has been received, following the model you see in the shop. Each piece is therefore an original and may differ slightly from the photograph and from other pieces of the same product in shape, size, shade of colour or small bubbles in the glass. Such minor differences are typical of handmade work and are not a defect.

2.2. The label "In stock" („Skladem“) means that the product is regularly available and can be ordered without prior arrangement. It does not mean that a finished piece is physically held in stock. The time within which we dispatch and deliver the goods is stated in Article 5 and on the Delivery and payment page.

2.3. The figures are decorative objects, not toys. Glass can break and the fragments can cause injury; keep them out of the reach of children.

2.4. A request for a product that the shop does not offer (a different colour, size or finish) is an individual enquiry. A contract is formed only once the seller has confirmed feasibility, price and delivery time and the buyer has accepted that offer. A note on an order does not by itself change the order.

3. Prices

3.1. Prices of goods are stated in Czech crowns and are final. The seller is not a VAT payer and therefore does not add VAT to the prices.

3.2. Delivery costs and any cash-on-delivery surcharge are not included in the price of the goods. Their amounts are stated on the Delivery and payment page and again in the order summary every time before the order is submitted. The total price including delivery is shown immediately before the order is submitted.

3.3. If the seller offers a discount, it also states the lowest price at which it offered the goods in the 30 days before the discount.

4. Order and conclusion of the contract

4.1. The buyer adds goods to the cart, fills in the contact and billing details at checkout, chooses the delivery and payment method and checks the order summary. Until submitting the order, the buyer can change all details and the contents of the cart and correct errors. A customer account is not needed to buy.

4.2. The buyer submits the order with the button "Place the order with an obligation to pay" („Objednat s povinností platby“). Before submitting, the buyer must confirm that they have read these terms and conditions and the information on withdrawal from the contract.

4.3. The contract is concluded when the order is submitted. The seller confirms acceptance of the order without undue delay on the order page and by email. The confirmation email contains a summary of the order and, as a PDF attachment, the text of these terms and conditions valid at the moment the order was submitted.

4.4. The seller may refuse the order or withdraw from the contract if the goods cannot be made (for example because material is unavailable) or if the price was stated in the shop obviously incorrectly. In that case the seller returns to the buyer without undue delay everything it has received from the buyer.

4.5. Before the goods are dispatched, the buyer may ask for the order to be cancelled (by email or from the confirmation email). The seller confirms the cancellation. This does not affect the consumer's statutory right to withdraw from the contract under Article 7.

5. Delivery time and shipping

5.1. The seller dispatches the goods within 3 working days of the payment being credited to its account, or, for cash on delivery, within 3 working days of the order being submitted. Carriage usually takes 2 working days, so the total time to delivery is usually 5 working days. This time includes making the figure and carriage.

5.2. If the seller finds that it will not deliver the goods within this time, it informs the buyer without undue delay and proposes a new date. A buyer who does not agree with the new date may withdraw from the contract, and the seller returns everything it has received from the buyer. Unless the parties agree otherwise, the seller delivers the goods no later than 30 days after the contract is concluded.

5.3. Delivery methods, delivery countries and prices are stated on the Delivery and payment page. We deliver goods only within the Czech Republic.

5.4. The goods are deemed handed over to the consumer at the moment the carrier hands them to the consumer or to a person designated by the consumer, or, for personal pickup, when they are collected. At that moment ownership of the goods and the risk of damage to them pass to the consumer. Article 11 applies to a buyer who is a business.

5.5. The buyer checks the parcel on receipt. If the packaging is visibly damaged, the buyer may refuse the parcel or make a damage report with the carrier. If the buyer discovers damage later, they notify the seller as soon as possible and attach photographs. This does not limit the consumer's rights arising from defective performance or the right to withdraw from the contract.

5.6. If the buyer does not collect a parcel that was properly dispatched and it is returned to the seller, the seller may claim reimbursement of the costs of sending it and of its return to the extent permitted by law.

6. Payment

6.1. The purchase price can be paid:

  • by bank transfer to the seller's account (the payment details and a QR code are shown after the order is submitted, and the payment details are also sent by email),
  • by cash on delivery when the parcel is received from the carrier, if this is offered for the chosen delivery method.

For personal pickup, payment is made in advance by bank transfer; payment in cash is not possible.

6.2. When paying by transfer, the purchase price is due within 7 days of the order being submitted. The payment is made when it is credited to the seller's account under the correct variable symbol. If the payment does not arrive in time, the seller contacts the buyer and agrees with them on how to proceed.

6.3. The seller issues the invoice, for payment by transfer, once the payment has been credited and, for cash on delivery, when the goods are dispatched. It sends the invoice to the buyer by email, and the buyer can download it from the order at any time; the seller encloses a paper copy with the parcel unless the buyer confirmed at checkout that they do not need it.

6.4. The seller charges no fees for the payment method other than the cash-on-delivery surcharge stated on the Delivery and payment page.

7. Information on the consumer's right to withdraw from the contract

7.1. The consumer has the right to withdraw from the contract without giving a reason within 14 days. The period runs from the day on which the consumer or a third party designated by the consumer (other than the carrier) takes possession of the goods. If the consumer ordered several pieces that are delivered separately, the period runs from receipt of the last piece.

7.2. The right to withdraw from the contract also applies to figures that the seller makes only after the order: they are products from the shop's range, not goods made to the consumer's specifications or clearly personalised. The consumer has no right to withdraw only for goods that were, at the consumer's request, actually made to their own specification beyond the shop's range (an individual enquiry under point 2.4); the seller expressly informs the consumer of this before such a contract is concluded.

7.3. To withdraw, it is enough to send the seller an unequivocal statement, for example by email to johanes-sklo@seznam.cz or by letter to Polská 528/43, 779 00 Olomouc. The withdrawal form below may be used, but it is not obligatory. The deadline is met if the consumer sends the notice before it expires. You can also withdraw from the contract online on the Claims and requests page with the button "Withdraw from the contract". The seller confirms receipt of the withdrawal by email.

7.4. The consumer returns the goods to the seller without undue delay, no later than 14 days after withdrawing, to the address Polská 528/43, 779 00 Olomouc. The deadline is met if the consumer sends the goods before it expires. Please do not send the goods cash on delivery, and pack them carefully – glass is fragile.

7.5. The consumer bears the direct cost of returning the goods. The goods can be returned by ordinary post or by a carrier.

7.6. The seller refunds the consumer without undue delay, no later than 14 days after the withdrawal, all money received, including the delivery costs – if the consumer chose a more expensive delivery method than the cheapest one offered, only the price of the cheapest one is refunded. The seller refunds the money in the same way in which it received it; for cash on delivery, to the bank account that the consumer provides, if the consumer agrees and incurs no additional costs as a result. The seller is not obliged to refund the money before it receives the goods or before the consumer proves that they have sent them.

7.7. The consumer is liable only for any diminished value of the goods resulting from handling them other than as necessary to establish their nature and characteristics. This does not prevent returning damaged goods; the seller may set off any compensation for the diminished value against the amount being refunded.

7.8. A detailed step-by-step procedure is in the section How to withdraw from the contract.

8. Rights arising from defective performance (defect claims)

8.1. The seller is liable to the buyer for the goods being free from defects when received, in particular for corresponding to the description in the shop, being fit for their usual purpose and having the usual characteristics. Minor differences under point 2.1 are not a defect.

8.2. The consumer may raise a defect that appears within two years of receiving the goods. If a defect appears within one year of receipt, the goods are presumed to have been defective already when received.

8.3. A defect can be raised with the seller by email to johanes-sklo@seznam.cz or in writing at the address Polská 528/43, 779 00 Olomouc. The seller gives the consumer a confirmation of the defect claim stating the date, the content of the claim, the requested remedy and the consumer's contact details.

8.4. The consumer may request delivery of a new piece without the defect or a repair, unless the chosen remedy is impossible or disproportionately costly compared with the other. For glass figures, delivery of a new piece is usually the appropriate remedy. The consumer may request a price reduction or withdraw from the contract if the seller has refused to remedy the defect or has not remedied it within a reasonable time, if the defect appears repeatedly, or if the defect is a material breach of the contract. It is not possible to withdraw from the contract because of an insignificant defect.

8.5. The seller handles the defect claim and informs the consumer of the outcome no later than 30 days after it was raised, unless they agree on a longer period. If the period expires without this, the consumer may withdraw from the contract or request a reasonable price reduction. The seller gives a confirmation of how the claim was handled with the date and the remedy, or, where applicable, with written reasons for rejecting it.

8.6. The seller bears the cost of sending the defective goods to the seller. If the defect claim is justified, the seller reimburses the buyer's postage on presentation of proof of payment.

8.7. Wear and tear caused by normal use and damage caused by the buyer, for example breakage after receipt, are not defects.

8.8. The detailed procedure is in the section How to make a defect claim.

9. Out-of-court dispute resolution and supervision

9.1. The seller handles complaints at the email address johanes-sklo@seznam.cz.

9.2. The Czech Trade Inspection Authority (Česká obchodní inspekce) is competent for out-of-court resolution of consumer disputes arising from the contract, website: https://coi.gov.cz/informace-o-adr/. A request can be filed no later than one year from the day on which the consumer first exercised their right with the seller.

9.3. Compliance with consumer protection obligations is supervised by the Czech Trade Inspection Authority (https://coi.gov.cz) and, within the scope of the Trade Licensing Act, by the Olomouc City Council, Trade Licensing Office (Magistrát města Olomouce, živnostenský úřad). The protection of personal data is supervised by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů).

10. Personal data

The processing of personal data is described on the Privacy and cookies page.

11. Buyer who is a business

11.1. If the buyer is a business purchasing in the course of its business, the provisions on consumer rights do not apply to it (in particular Article 7, the periods in Article 8 and point 5.4). The risk of damage to the goods passes to it when the goods are handed over to the first carrier.

11.2. The rights of a business buyer arising from defective performance are governed by Section 2099 et seq. of the Civil Code. The buyer inspects the goods as soon as possible after the risk of damage has passed and notifies a defect without undue delay after it could have discovered it by a timely inspection, and for a hidden defect no later than two years after handover.

12. Final provisions

12.1. Legal relations not governed by these terms are governed by Czech law, in particular the Civil Code (Act No. 89/2012 Coll.) and the Consumer Protection Act (Act No. 634/1992 Coll.). The choice of law does not deprive a consumer whose habitual residence is in another country of the protection afforded by the mandatory provisions of that country's law.

12.2. The seller may change these terms. The contract is governed by the version in effect at the moment the order was submitted; the buyer receives it as an attachment to the confirmation email.

12.3. These terms include the withdrawal form and the procedures how to withdraw from the contract and how to make a defect claim.

Defect claims and withdrawal from the contract – procedure

Returning goods without giving a reason (withdrawal from the contract) and a defect claim for faulty goods are two different things with different deadlines. If you are not sure which applies to you, write to us at johanes-sklo@seznam.cz – we will advise you.

  • When – Withdrawal from the contract: you do not like the goods, you do not want them; Defect claim: the goods are faulty, damaged or do not match the description
  • Deadline – Withdrawal from the contract: 14 days from receiving the goods; Defect claim: a defect that appears within 2 years of receipt
  • Reason – Withdrawal from the contract: not needed; Defect claim: a description of the defect
  • Return postage – Withdrawal from the contract: you pay; Defect claim: we pay
  • Outcome – Withdrawal from the contract: refund within 14 days of withdrawal; Defect claim: a new piece, repair, price reduction or refund, within 30 days

How to withdraw from the contract

This applies to consumers. You also have the right to withdraw from the contract for figures that we make only after your order.

  1. Let us know within 14 days of receiving the goods that you are withdrawing from the contract. The quickest way is online on the Claims and requests page with the button "Withdraw from the contract". An email to johanes-sklo@seznam.cz or a letter to Polská 528/43, 779 00 Olomouc is also enough. You can use the withdrawal form, but it is not obligatory. Please state the order number and, for cash on delivery, the account number for the refund. It is enough to send the notice on the last day of the period.
  2. We confirm receipt of the withdrawal by email.
  3. Send the goods back to us within 14 days of withdrawing, to the address Polská 528/43, 779 00 Olomouc. The deadline is met if you send the parcel within this time. You pay the return postage. We do not accept parcels sent cash on delivery.
  4. Pack the figure carefully – glass is fragile and breaks easily in transit if badly packed. You do not have to return the original packaging.
  5. We refund the money within 14 days of the withdrawal, in the same way you paid (for cash on delivery, to the account you give us). We refund the price of the goods and the cost of delivery to you, but no more than the price of the cheapest delivery method offered. We can refund the money only after we receive the goods or after you prove that you have sent them.

If you return the goods damaged or used other than as necessary to examine them, we may ask you to compensate for their diminished value.

You cannot withdraw only for goods made to your individual specification outside the shop's range. We always tell you this expressly in advance, before you accept such an order.

How to make a defect claim

  1. Write to us at johanes-sklo@seznam.cz, or send a letter to Polská 528/43, 779 00 Olomouc. State the order number, a description of the defect and what you request (a new piece, a repair, or a price reduction or withdrawal), and attach photographs of the goods and, if the damage happened in transit, of the packaging.
  2. We send you a confirmation that we have received the claim by email. It states the date on which you raised the claim, what you are claiming, the remedy you request and your contact details.
  3. Send the goods to us if we ask you to. We pay the cost of sending them. If the claim is justified, we reimburse your postage on presentation of proof of payment. If the goods were obviously damaged in transit, photographs are often enough and you do not have to send the goods back.
  4. We handle the claim no later than 30 days after it was raised, unless we agree with you on a longer period. For glass figures we usually send a new piece; if that is not possible, we agree a price reduction or refund your money.
  5. We send you a confirmation of how the claim was handled with the date and the remedy. If we reject the claim, we state the reasons in writing.

If we do not handle the claim within 30 days, you may withdraw from the contract or request a reasonable price reduction.

If a defect appears within one year of receipt, the goods are presumed to have been defective already when received. Minor variations typical of handmade work (shape, shade, bubbles in the glass) and damage that occurred only after receipt are not defects.

A buyer who is a business makes a claim the same way; its rights are governed by Article 11 of the terms and conditions.

If you are not satisfied with how the claim was handled, you can turn to the Czech Trade Inspection Authority (Česká obchodní inspekce) with a request for out-of-court dispute resolution (https://coi.gov.cz/informace-o-adr/).
